1. Purpose and acceptance of the general conditions
The Leonor Greyl website (referred to hereinafter as the "Website") is an e-commerce site that is accessible via the Internet at the address www.leonorgreyl.com. It is open to any Internet user (referred to hereinafter as the "Internet User"). It is published by the Leonor Greyl company (referred to hereinafter as "the vendor"), a Simplified join stock company with a capital of 38.252 euros, with a head office located at 29, rue du Terrage, 75010 Paris, France and enrolled on the Paris Register of Trade and Companies under number 997 888 516 00017
The site is hosted by the 1 & 1 company, whose head office is located at 7, place de la Gare, 57200 Sarreguemines, France.
The Website enables Leonor Greyl to offer "Leonor Greyl" -branded cosmetic hair care products for sale to Internet Users browsing the Website (referred to herein after as "Users"). For the purposes of this document, it is agreed that the User and Leonor Greyl will be collectively referred to as the "Parties" and individually referred to as the "Party", and that once he has confirmed an order, the User will be referred to as the "Purchaser". The User's rights and obligations apply to the Purchaser automatically.
Any Product order proposed on the Website assumes that the present general conditions of sale have been read and expressly accepted; the User does not need to provide a handwritten signature. In accordance with the provisions made in articles 1316 to 1316-4 of the French civil code, supplemented by Decree no. 2001-272 dated 30 March 2001, for the application of article 1316-4 of the French civil code and concerning electronic signatures, it must be noted that the confirmation of the purchase order as specified in article 3.3 below constitutes an electronic signature that bears the same value as a handwritten signature for both Parties.
It is hereby stated that the User may save or print the present general conditions of sale, provided that they are not modified.
The present general conditions of sale are valid from 1 November 2009.
Leonor Greyl reserves the right to amend the present general conditions and specific conditions of sale at any moment, without advance warning, it being understood that such amendments will not be applicable to any reservations or orders accepted and confirmed by the purchaser prior to the changes being made. The present conditions apply to the exclusion of all other documentation.
2. Products sold on LeonorGreyl.com
All the products sold by the Website are limited to Metropolitan France, Corsica, Principality of Monaco, Belgium, Germany, United Kingdom (England, Northern Ireland, Scotland, Wales), Spain (with the exception of the Canary Islands, Mellila and Ceuta), Sweden, Denmark (with the exception of the Faroe Islands and Greenland), the Netherlands (with the exception of the Saint Martin island), Finland (with the exception of the Åland Islands), Croatia, Hungary, Ireland, Poland, Czech Republic, Romania, Bulgaria, Slovakia, Slovenia and mainland Greece.
In the event that one or several products become(s) unavailable after an order has been placed, you will be informed by email. The sum of your order will be recalculated and the new sum will be debited from your account, with the missing products removed. If all of your order is unavailable, you will be informed by email and no sum will be debited from your account.
In accordance with article L. 111-1 of the French consumer code, the Purchaser may find information on the Leonor Greyl Website regarding the essential characteristics of the product or products that he wishes to order prior to placing an order.
The photographs, graphics and descriptions of the products proposed for sale are for informative purposes only and are in no way binding for the vendor.
3. Prices of the products sold on the Website
The prices that appear on this Website are indicated in euros including all taxes and are subject to variation over the course of the year, given that the products ordered are invoiced at the price in force at the time of ordering.
They do not include delivery charges, which are invoiced in addition to the price of the products purchased in accordance with the sum of the order. The delivery charges will be indicated before the order is registered by the Purchaser.
The prices include the value-added tax (VAT) applicable on the day the order is placed. Any applicable changes in rate will be automatically reflected in the price of the products sold by Leonor Greyl on its Website.
The sales prices of the products can be modified by Leonor Greyl at any time. The Purchaser will be informed of any such modifications before any order is completed.
Any order assumes the acceptance, with neither restriction nor reservation, of the present general conditions of sale. Prior to placing an order, the Purchaser declares that the purchase of products on the Leonor Greyl website does not have any direct relationship to his professional activity, is limited to strictly personal use, and that he has full legal capacity allowing him to agree to the present general conditions of sale.
The sum of each order is limited to 500 euros excluding taxes per order. The Purchaser can order a maximum number of 10 items of one given product at a time.
As soon as the order is registered, a detailed acknowledgement of receipt message will be sent to the Purchaser at the email address indicated by him.
This acknowledgement of receipt message will specify the exact sum invoiced and the delivery details for the order.
The Purchaser can check the details of his order and correct any errors. From the moment the Purchaser confirms his order by clicking on the "Confirm your payment" icon, the present general conditions of sale, the prices, volumes and quantities of the products offered for sale and ordered by the Purchaser are considered to have been understood and accepted.
The order confirmed by the Purchaser will then be confirmed by Leonor Greyl. The sale will not be considered definitive until this order confirmation has been made available to the Purchaser by Leonor Greyl and the entire sum has been collected by the latter.
Leonor Greyl advises the Purchaser to keep a copy of the information contained in the order confirmation message sent by Leonor Greyl in paper or digital format.
However, Leonor Greyl reserves the right to cancel any order placed by a customer with whom any dispute exists regarding the payment of a previous order, or for any other legitimate reason, particularly for any order that appears to be abnormal in nature.
All orders are to be paid for in euros, inclusive of all taxes and obligatory contributions. The Purchaser remains liable for any bank charges (such as foreign exchange commission), including in the event of a reimbursement.
The payment must be made online by the Purchaser when placing the order. At no stage may the sums paid be considered to be advances or down payments.
The Purchaser may use the following means of payment to settle his order: bank card (Carte Bleue, Visa, American Express and Master Card), which must be issued by a banking or financial establishment situated within the European Union or Monaco.
The Purchaser guarantees Leonor Greyl that he holds any necessary authorisation to use the means of payment that he has chosen during the registration of the purchase order.
Leonor Greyl reserves the right to suspend or cancel any order and/or delivery, whatever its nature and stage of processing, in the event of non-payment of any sum owed by the Purchaser or in the event of a payment incident.
Penalties equal to the legal interest rate with a five-point surcharge are legally applicable to the unpaid sums from ten days after the invoicing date or the date of notification that the bank has rejected the payment for any other means of payment.
Delivery of any new order may be suspended in the event of a delay in payment for a previous order, the provisions of this document notwithstanding.
For the purposes of counteracting Internet fraud, the information regarding your order may be transferred to any third party for verification.
In order to ensure the security of payment by bank cards, the purchaser is obliged to provide Cyberplus with the visual cryptogram (CVV) of his bank card.
Leonor Greyl reserves the right to request a photocopy of the Purchaser's ID and/or, if applicable, bank card (back only) for any payment by bank card.
6. Delivery of orders
The products will be delivered to the address indicated by the Purchaser on the purchase order by "Colissimo Suivi" or "Chronopost" depending on the Purchaser's choice.
The delivery will take place on average within 5 to 8 days from receipt of the purchase order, depending on the delivery method chosen by the Purchaser.

Characteristics of the French post office's "Colissimo Suivi" delivery service
Upon delivery, a distribution slip or acknowledgement of receipt must be signed by the Purchaser or the recipient of the products ordered. In the event of his absence, the Purchaser or recipient of the order will receive a non-delivery notice allowing him to collect the products ordered from the Post Office indicated in the non-delivery notice within two weeks.
After this time, the package will be returned to the sender.
Characteristics of the French post office's "Chronopost" delivery service
Upon delivery, an electronic acknowledgement of receipt must be signed by the Purchaser or the recipient of the products ordered. In the event of his absence, the Purchaser or recipient of the order will receive a non-delivery notice allowing him to collect the products ordered from the Post Office indicated in the non-delivery notice within two weeks.
After this time, the package will be returned to the sender.
The Purchaser or recipient of the products ordered is invited to check the visible state of the products at the time of delivery. In the event of a visible anomaly (damage, missing product listed on the delivery slip, damaged or broken package or product, etc.) noted during delivery in the presence of the Post Office representative, the Purchaser or recipient of the products ordered must follow the Post Office's Colissimo complaints procedure by indicating the damage or missing products noted, expressing all grievances and reserves and refusing the delivery, issuing a non-conform order report to the Post Office official immediately.
In the event of a visible anomaly (damage, product missing listed on the delivery slip, damaged or broken package or product, etc.), the Purchaser or recipient of the products ordered has 3 clear days from receipt of the order to notify the transporter, on the delivery slip or by registered letter with acknowledgement of receipt, of any incident regarding the state or contents of the package delivered. He is also invited to notify Leonor Greyl of the problem by calling the Leonor Greyl customer services on +33 (0)1 46 07 58 23.
7. Product returns and refunds
The products may be returned by the Purchaser according to the following conditions and instructions:
The products must be returned to Leonor Greyl without fail in perfect, saleable condition, in their original state (packaging, accessories, instructions, etc.) duly sealed and accompanied by a copy of the invoice.
Leonor Greyl accepts the return of any article purchased on the Website if it is returned within 7 days from the date of receipt of the goods ordered by the Purchaser.
In principle, the postage charges for returning the package must be met by the Purchaser. In the event of a technical anomaly or an error regarding the items delivered, the postage charges for returning the package will be reimbursed by Leonor Greyl.
To return an article, the Purchaser must follow the instructions below:
1. Use the original packaging to return the product.
2. Enclose the invoice related to the order. Returns without a copy of the invoice will not be accepted.
3. Send the package to the following address:

Any risk connected to the return of a product must be borne by the Purchaser.
If the procedure outlined above and the time periods indicated are not respected, the Purchaser cannot make any claims for any non-conformity or visible flaws of the products delivered, as the products will then be considered to conform to the order and be exempt from any visible flaws.
8. Rescission rights
In accordance with article L. 121-20 of the French consumer code, the Purchaser has 7 clear days from the date on which the goods are received to return the products ordered, at his own expense, for a refund.
The products must be returned to Leonor Greyl without fail in perfect, saleable condition, in their original state (packaging, accessories, instructions, etc.) duly sealed and accompanied by a copy of the invoice according to the procedure described in point 7 above.
If the procedure outlined above is respected, the refund will be made by re-crediting the Purchaser's bank account within 15 days of receipt of the package.
9. Ownership rights
Leonor Greyl maintains full, total ownership of the products sold until receipt of the full principal price, including fees and taxes.
Leonor Greyl cannot be held responsible for the non-fulfilment of the contract in the event that a product is out-of-stock or unavailable due to a case of force majeure, or in the event of disruption or a total or partial strike, particularly concerning postal services and transportation and/or communications systems.
Leonor Greyl cannot be held responsible for any indirect damages that may arise from the purchase of its products.
Leonor Greyl declines all responsibility for any loss of data or files. It is the responsibility of the Purchaser to make all necessary back-up files.
Leonor Greyl declines all responsibility:
- for any suspension of the Website;
- for any technical problems on the Website;
- for any inaccuracy or omission in the information available on the Website;
- for any damages resulting from a fraudulent intrusion on the part of a third party leading to a modification of the information provided on the Website;
- and more generally for any direct or indirect damages, whatever their causes, origins, nature or consequences, including any costs that may arise from the purchase of the goods offered for sale on the Website, loss of profits, of clientele, of data or any other loss of intangible goods that may arise from any person accessing the Website, from the impossibility of accessing it or from a reliance on any piece of information that comes directly or indirectly from the Website.
11. Intellectual property
In accordance with the laws governing literary and artistic property rights or any similar rights, the present Website and all the elements, brands, designs, models, logos, graphics, etc., found on the present Website as well as their compilation are the exclusive property of Leonor Greyl, who grants no licence or any right other than the right to consult the Website.
Any reproduction or use of all or part of these elements is only authorised for informative purposes and for personal private use. Any reproduction or use of copies produced for other purposes is expressly forbidden. Any other use amounts to forgery and is sanctioned as an infringement of Intellectual Property, unless prior, written agreement is provided by Leonor Greyl.
12. Governing statute and jurisdiction
The sale of the Leonor Greyl company’s products is subject to French law. Unless an amicable agreement can be made, any dispute regarding the interpretation, enforcement or breach of the contract agreed between Leonor Greyl and the Purchaser, including in the case of multiple respondents, will come under the exclusive jurisdiction of the courts of Paris.
13. Data protection and freedom
The information collected by Leonor Greyl from every order placed by the Purchaser is necessary for the management of his order by Leonor Greyl and its commercial partners. In accordance with the French Data Protection Act no. 78-17 dated 6 January 1978, the Purchaser has the right to access, correct, oppose and withdraw any data concerning him that is held by Leonor Greyl.
